TITUSVILLE, Fla. -- State Rep. Bob Allen will go to trial on a solicitation of prostitution charge Sept. 19.
Judge Oscar Hotusing also said he would rule by the end of the week on Allen's defense motion to suppress some of Allen's statements to police when he was arrested, Local 6 News partner Florida Today reported.
Assistant State Attorney Pat Whitaker said he plans on using just two of what he called voluntary statements by Allen: one where he asks, as he's being arrested, if his legislator status would "make a difference," and another where he admits to having $800 in his car.
Statements police said Allen made about being scared of a "stocky, black man," will not be entered into evidence. Also, taped statements Allen made to Assistant Chief John Lau will also be excluded, as previously agreed to by both sides.
Both sides downplayed the importance of the taped statements to Lau, with Whitaker saying the state can make its case without them, and defense attorney Greg Eisenmenger saying that all the statements did was put Allen in a bad light, not prove wrongdoing.
