Judge Won't Toss Allen's Statement In Sex Case

Ruling Calls Representative's Words Spontaneous

Brevard County Court Judge Oscar Hotusing denied a request to toss statements state Rep. Bob Allen made immediately after his July 11 solicitation arrest.

During the arrest at Space View Park, Titusville police said Allen asked if his position as a lawmaker would "help."

Hotusing ruled on Thursday that the statement was made spontaneously and not in response to questioning by Titusville Cpl. Erich Barrett, who was placing the seven-year lawmaker in his cruiser, Local 6 News partner Florida Today reported.

Allen, R-Merritt Island, is scheduled to go to trial Sept. 19 on one count of solicitation for prostitution.

Titusville police said Allen agreed to pay $20 to perform a sex act on an undercover officer.
