TITUSVILLE, Fla. -- A judge on Tuesday reset until November state Rep. Bob Allen's trial on solicitation charges.
Allen's attorney, Greg Eisenmenger, argued in court for a continuance based on delays by the prosecution in turning over discovery evidence in time to prepare for trial, which was to begin on Wednesday, Local 6 News partner Florida Today reported.
However, Judge Oscar Hotusing told Eisenmenger that his client could either go to trial on Wednesday or waive his client's rights under the state's speedy trial law, which would have required Allen stand trial no later than Oct. 8.
Hotusing reset the trial for November, although an actual trial date was not announced.
Allen, a Meritt Island Republican, faces the misdemeanor charge stemming from a July 11 incident in which he was accused of offering an undercover Titusville police officer $20 in exchange for a sexual act.
Hotusing previously denied defense motions to suppress evidence and dismiss the charge.
Allen was in court with his wife, Beth.
