Rep. Allen's Sex Case Back To Nov. 5 Start

Representative Accused Of Soliciting Undercover Officer

The misdemeanor solicitation trial for state Rep. Bob Allen will start on Nov. 5 after all.

Brevard County Judge Oscar Hotusing determined on Friday morning that Allen's defense was not ready to go to trial and continued the trial to the previously set date, Local 6 News partner Florida Today reported.

The trial had been moved up after Allen's attorney, Greg Eisenmenger, filed a notice of expiration of speedy trial.

That filing, however, was not an attempt for the trial to be moved up, but rather a legal maneuver to preserve Allen's right to appeal if the case does not conclude favorably for the seven-year lawmaker, Eisenmenger said.

Eisenmenger waived his client's right to a speedy trial on Sept. 18 only after a ruling by Hotusing with which the defense did not agree.

Allen, R-Merritt Island, is accused of agreeing to pay $20 to perform a sexual act on an undercover Titusville police officer in a Space View Park restroom.

Allen did not appear in court on Friday.
