DAVENPORT, Fla. -- A Central Florida man is accused of shaking and killing a 6-month-old baby because the boy disturbed his video game playing.
Enrique Santos, 24, of Davenport, was arrested on a charge of first-degree murder in the death of Elishmael Rodriguez.
According to an arrest affidavit, Wanda Rodriguez, who lives at 2911 Holly Hill Cutoff Road in Davenport with her two sons and Santos, left home at about 5 p.m. to go to work, leaving her children in the care of Santos.
Santos put the 6-month-old boy to sleep in a playpen in the bedroom at about 10 p.m., the affidavit said. At about 1 a.m. the baby woke up crying while Santos was playing a video game, according to the affidavit.
Santos gave the baby Tylenol, but he wouldn't stop crying, he told Polk County sheriff's deputies. Santos said he picked the baby up and shook him, yelling, "Why won't you stop crying?" the affidavit said. Santod then violently threw the baby into the playpen, according to the affidavit.
The baby became limp and started gasping, so Santos took him next door to the boy's grandmother's house, where they called for an ambulance to take him to the Heart of Florida Hospital, deputies said.
Santos originally told detectives that the baby must have fallen out of bed while he was sleeping and injured himself, but later admitted that he shook and threw the baby, deputies said.
The baby was transported to Arnold Palmer Hospital in Orlando, where he was pronounced deceased at 10:35 a.m. Tuesday.
An autopsy revealed that Rodriguez died as a result of numerous injuries to his head, neck and torso consistent with blunt-force trauma and violent, sudden shaking.
"We were notified by the hospital in Orlando about this baby's significant injuries, and with full cooperation of everyone involved we were able to put the man responsible for Elishmael's tragic death behind bars. This was a violent and senseless murder of an innocent baby, and hopefully justice will be served and Enrique Santos will spend the rest of his life behind bars," Polk County Sheriff Grady Judd said.
"The Department of Children and Families is also investigating the circumstances of the death, confirming that there was no prior DCF history with the deceased child and working to ensure the safety and needs of the surviving sibling are being met," said Carrie Hoeppner of DCF.
Santos was being held in the Polk County Jail under no bond.
