Civil Case Against Anthony Can Proceed

Woman With Same Name As Nanny Seeks $15,000

A judge ruled on Tuesday that Zenaida Gonzalez can still sue Casey Anthony.

Anthony's attorney went to court to get the civil suit thrown out, but Gonzalez's attorney, Keith Mitnik, filed an amendment to the suit that included additional allegations against Anthony.

The new information in the suit included additional evidence that Anthony additionally tried to harm Gonzalez's reputation.

Mitnik claimed that Gonzalez remained unemployed for months due to Anthony's claim that a babysitter named Zenaida Gonzalez kidnapped her daughter, Caylee Anthony.

The revised lawsuit also includes a request for additional punitive damages from Anthony.

"This is about punishment. It's about accountability for what you did. About retribution for what you did," Mitnik said.

Detectives said they showed Anthony a photo of Gonzalez and she did not recognize the woman, but during a jail visit, recordings show Anthony telling her parents a different story.

"When they went and interviewed that girl down in Kissimmee they never showed me a picture of her. The never searched by her full name," Anthony told her parents.

"Well they told us you couldn't pull her out of a lineup," Cindy Anthony responded.

"They're full of (expletive)," Casey Anthony said.

Cindy Anthony repeated her daughter's statement to TV news crews.

"My daughter said they never showed her picture. That's what they told me. She didn't look at any lineups," Cindy Anthony said.

"She stood in front of a bunch of cameras and denied she had cleared Zenaida Gonzalez by looking at the photograph, therefore putting the cloud of suspicion right back on our client's back," Mitnik said.

Casey Anthony's lawyer, Jonathan Kasen, will have to file another motion to dismiss the suit now that Gonzalez's lawyer has amended the lawsuit.

"You cannot intentionally harm someone you don't know. It's sort of axiomatic. You can only harm an individual that you have contact with and that you know, and in this case, neither applies," Kasen said.

Gonzalez's attorneys have not disclosed how much money they're seeking, but if they win, they plan to pursue any profits from book or movie deals.

Another hearing in the civil case will be held on Thursday. Gonzalez's legal team will try to force member's of Anthony's family to answer questions they refused during their depositions.

Caylee was 2 years old when she went missing last June, but her remains were not found until last December. She had been missing for about a month before her mother reported it.

Casey Anthony has been charged with first-degree murder and has pleaded not guilty.

Casey Anthony did not attend the hearing, but her parents did attend with their lawyer Brad Conway.
