Brawl Ensues Over $1 Worth Of Gas

Police: Gas Station Clerk Attacked With Squeegee

A convicted felon was charged with battery after witnesses said he attacked a gas station clerk over a dispute over $1 worth of gas.

The incident happened at the Circle K on South Nova Road near Daytona Beach.

A witness and the clerk called 911 around 10:45 p.m. to report an attack.

The clerk told the 911 dispatcher a customer hit him in the head with a squeegee.

"I just had a belligerent customer who's attacked me with a gas stick at my gas station," the clerk told a dispatcher.

"We just pulled up and he grabbed one of the car squeegees and went after the guy working in the store," a witness told a dispatcher. "I think he was screaming about his money or something."

When Volusia County sheriff's deputies arrived, the clerk told them that the man was upset after he prepaid for $10 of gas and the fuel pump failed to work. The clerk said the man had used $1.03 worth of gas and he offered to give him back $9, but the man demanded a full refund.

The clerk said a physical altercation ensued and displays were knocked over. The man left, but returned with a squeegee and hit the clerk in the head with it, the clerk said.

Deputies found Lawrence Toby at the scene. Deputies said Toby told them he overreacted.

Toby was charged with battery and criminal mischief as well as violation of probation. He is being held at the Volusia County Branch Jail in Daytona Beach.
