Neighbors have complained about Alan Davis, 46, and the piles of junk and rats in his yard for more than 10 years, Local 6 News reported.

In 2001, the state filed criminal littering charges claiming he illegally dumped trash in his yard and is maintaining a health hazard by not cleaning his yard.

Now, a jury will decide whether Davis broke the state's litter laws and the county's nuisance ordinances.

Davis' attorney's argued Tuesday that he is an artist and his yard is a political statement protected by the constitution.

However, prosecutors said that Davis thinks he is above the law and that annoying the government has become an obsession, Local 6 News reported.

The jury of four women and three men will hear from Davis this week and may take a field trip to his home to see for themselves.

Last year, Davis was arrested after he created the sculpture of a bare torso and placed it in the front yard of his home on Alpine Street in Altamonte Springs. A neighbor called 911 to complain that the statue was obscene, and Davis was charged with disorderly conduct and resisting an officer.

Despite being charged with more than $300,000 in fines, Davis has refused to clean up the junk or remove the statue.

Davis faces up to 5 years in prison.
