Owner Of Assisted Living Facility Accused Of Neglect

POSTED: Tuesday, December 16,
UPDATED: 4:30 pm EST December 16, 2003

The owner of an assisted living facility in Melbourne, Fla., is charged with neglect after she allegedly abandoned the facility and left it in the care of a convicted felon, according to a report.

Gail King Dellinger, 52, surrendered to authorities at the Viera Courthouse in Judge Warren Burke's courtroom Monday and was taken to the Brevard County Detention Center where she was booked on a $10,000 bond, Local 6 News partner Florida Today reported.

Dellinger's arrest comes after several state investigators responded to the King Manor located at 3255 Fell Road.

"Investigators learned that the owner and operator, Gail King Dellinger, had left the state to work as a nurse for another company," Brevard Country sheriff's spokeswoman Yvonne Martinez told Florida Today. "Trouble then developed at King Manor and the lone care worker responsible for three elder residents asked Ms. Dellinger to return to the home."

Martinez said Dellinger did not return to King Manor and the lone care worker "was suffering from fatigue and was having a break down."

Florida Today reported that the worker left in charge is a convicted felon on probation. In 2002, John Harrison Brown, 38, was convicted of a felony battery to an emergency medical care provider, according to the report. He failed to show up in court on Aug. 12, 2002 and was arrested for violating probation on Dec. 9, according to Clerk of Court records.

As a result of this investigation, King Manor's state operating license was seized and the three residents living there have since been relocated to other facilities. All were unharmed and in fair health, Martinez said.

"Ms. Dellinger failed to notify proper authorities that trouble was developing in the home," Martinez said. "The Brevard County Sheriff's Office has closed its investigation with the arrest of Ms. Dellinger."

However, Martinez added that there are several state and local investigations pending.
