A state senator suspected of drunken driving who was reportedly filmed refusing to answer officers' requests to take a breath-alcohol test in May, will likely lose his driver's license Tuesday, according to Local 6 News.

Lee Constantine, R-Altamonte Springs, was arrested early May 9 after a Maitland police officer spotted Constantine drifting in and out of lanes and smelled alcohol on his breath, according to a police report.

His license hearing is scheduled Tuesday.

Since Constantine refused to take a Breathalyzer test when he was pulled over by police, state law requires that his driver's license will be suspended for one year, according to the report.

Constantine pleaded no contest to DUI in 1990, while he was still an Altamonte Springs city commissioner.
