Store Clerk Charged With Urinating Into Soda Bottle

Man Becomes Violently Ill After Drinking Urine-Filled Mountain Dew

A convenience store worker was arrested and charged Thursday after he confessed to urinating into a soda bottle, causing a customer who drank from it to become violently ill, according to a sheriff's report.

Police said Anthony Mesa, 21, will be charged with tampering with a consumer product, which is a first-degree felony. The Volusia County Sheriff’s Office also has filed a complaint affidavit against a second clerk accused of being in on the prank.

Earlier this week, Mesa was suspended from a Publix-owned Pix convenience store located off Howland Boulevard in Deland, Fla. after his employers learned of the alleged incident.

    The Sheriff's Office initiated a criminal investigation on Tuesday after news reports of the incident surfaced.

    The 31-year-old victim, referred to by the initials "LT" in the arrest affidavit, bought the 20-oz. bottle of Mountain Dew and began drinking it. After realizing the drink didn't taste right, he started vomiting in the parking lot and then went back into the store to complain to the manager.

    The store conducted its own investigation, which focused on Mesa, according to the sheriff's report. Mesa did not confess to sheriff’s investigators but he gave a statement to his employer admitting what he did, according to the report.

    "I don't care if I'm fired and prosecuted because I deserve it," Mesa said in his statement. "Sorry for being immature."

    Lab tests done by Publix on the contaminated Mountain Dew confirmed the soda contained urine, an official said

    "It is an isolated incident done by one of our associates," Stevens said. "Whatever measure is necessary, it will be executed and the employee will be dealt with."

    The victim, a foreman with a Daytona Beach construction company, became suspicious of the drink after he chugged the beverage last week, his attorney, Daniel Newlin, said

    "He vomited three or four times afterward," said Newlin.

    Newlin said that upon the advice of an infectious-disease doctor, the victim was being tested for diseases such as gonorrhea and hepatitis C.

    "We're hopeful that the person who did this wasn't carrying any sexual, or otherwise, virus that could cause him harm," Newlin said. "Unfortunately, the doctors were very concerned."

    The Sheriff's Office also filed a complaint affidavit against 20-year-old William Bonilla, a Pix clerk who's accused of coaxing Mesa into the prank.

    The State Attorney's Office will decide whether any criminal charges will be filed against Bonilla.
