Backgrounder: Motorcycle Helmet Laws

In Pennsylvania:
  • A motorcycle operator who is 21 years old or older doesn't have to wear a helmet. (Anyone under 21 must wear a helmet.)
  • A motorcycle operator who has been licensed to operate a motorcycle for at least two years or who have completed a motorcycle rider safety course approved by the Department of Motor Vehicles or the Motorcycle Safety Foundation doesn't have to wear a helmet.
  • A passenger who is 21 years old or older, so long as the operator of the bike is not legally required to wear a helmet.
  • The operator or passenger in a three-wheeled motorcycle equipped with an enclosed cab doesn't have to wear a helmet.

Facts about current U.S. Motorcycle and Bicycle Helmet laws as of April 2006 (no changes since September 2005):
  • 20 states and the District of Columbia have a law requiring all motorcyclists to wear a helmet.
  • 26 states have a law requiring only some motorcyclists to wear a helmet. 4 states do not have a motorcycle helmet use law.
  • 20 states and the District of Columbia have a law requiring some bicyclists to wear a helmet.
  • 30 states do not have a bicyclist helmet use law.

The causes of many motorcycle crashes can be attributed to:
  • Lack of basic riding skills.
  • Failure to appreciate the inherent operating characteristics.
  • Failure to appreciate the limitations of the motorcycle.
  • Failure to use special precautions while riding.
  • Failure to use defensive driving techniques.
  • Lack of specific braking and cornering skills.
  • Failure to follow speed limit.
