Backgrounder: Motorcycle Helmet Laws
- A motorcycle operator who is 21 years old or older doesn't have to wear a helmet. (Anyone under 21 must wear a helmet.)
- A motorcycle operator who has been licensed to operate a motorcycle for at least two years or who have completed a motorcycle rider safety course approved by the Department of Motor Vehicles or the Motorcycle Safety Foundation doesn't have to wear a helmet.
- A passenger who is 21 years old or older, so long as the operator of the bike is not legally required to wear a helmet.
- The operator or passenger in a three-wheeled motorcycle equipped with an enclosed cab doesn't have to wear a helmet.
- 20 states and the District of Columbia have a law requiring all motorcyclists to wear a helmet.
- 26 states have a law requiring only some motorcyclists to wear a helmet. 4 states do not have a motorcycle helmet use law.
- 20 states and the District of Columbia have a law requiring some bicyclists to wear a helmet.
- 30 states do not have a bicyclist helmet use law.
- Lack of basic riding skills.
- Failure to appreciate the inherent operating characteristics.
- Failure to appreciate the limitations of the motorcycle.
- Failure to use special precautions while riding.
- Failure to use defensive driving techniques.
