DeLand police say an officer caught a man swallowing a marijuana joint after he was pulled over for not wearing his seat belt.
Nicholas Gear, 27, was arrested and charged with possession of marijuana less than 20 grams and destroying/tampering with evidence on Wednesday.
Police said when the officer approached Gear's car, they smelled marijuana. When asked if Gear smoked marijuana, he denied it and the officer told him to get out of the car, according to the report.
Gear then grabbed an unknown substance from under his radio console and put it in his mouth, chewed it up and opened up his mouth to show the officer nothing was left. The officer found black pieces from the joint in Gear's mouth and arrested him.
Gear later told police he had been smoking the joint when he was pulled over. According to the report, Gear told police he was scared and that's why he put the joint in his mouth.
Gear was taken to the Volusia County Branch Jail on $1,500 bond.
