BREVARD COUNTY, Fla. – The mother of one of two fisherman killed by a distracted driver on an Eau Gallie bridge is taking the driver to court.
Kim Wright is seeking an unlisted amount of damages from Vincent Worbington, according to documents filed Tuesday in the wrongful death lawsuit, according to Local 6 News partner Florida Today.

Wright's son, 25-year-old Justin Mitchell, and 24-year-old Garrett Viccaro were fishing of an Eau Gallie bridge late April 1 when they were hit by an SUV. Mitchell suffered spinal cord injuries and was thrown into the Indian River, where he drowned. Viccaro also died of his injuries. A third man, Jeff VanReenen, was struck and injured.
Police crash investigators determined Worbington had looked down at a text message while behind the wheel of his SUV. The rig veered off the road, into the bridge wall and the three fisherman. He was given a traffic ticket months later and sentenced to a fine and community service, building a memorial for the victims.
Now, Wright is seeking reimbursement for her son's estate, burial costs and "mental pain and suffering damages." There is no monetary amount listed in the filing.
Online court records show no other civil cases have been brought against Worbington; though VanReenen and Viccaro's families have retained attorneys.
