Dad charged after 2-year-old son shot in Orange County

Michael Garcia charged with child neglect, culpable negligence in relation to shooting

ORANGE COUNTY, Fla. – The father of a 2-year-old boy that accidentally shot himself in the legs with a .45-caliber gun walked out of jail late Tuesday night after posting bond.

The Orange County Sheriff's Office said 29-year-old Michael Garcia was arrested and charged Tuesday with child neglect and culpable negligence in relation to the shooting last Tuesday, Oct. 8 on West Livingston Street.

Deputies said the boy was shot in both legs with a single shot. The toddler was in a back bedroom when deputies said he got ahold of his father's gun.

The boy's grandmother, his father and a family friend were in the home that Tuesday afternoon when deputies said he was shot.

The Department of Children and Families began investigating the shooting last week, saying they were talking with the people who lived at the home and tried to determine if the home was safe for the 2-year-old boy and another child who was staying there.

The boy was taken to the hospital, but doctors say his injuries are not life threatening.
