Lawyers to determine if Luis Toledo's case will move to trial

DELTONA, Fla. – The Deltona man accused of killing his wife and her two kids will appear in court on Tuesday to possibly set a date for his murder trial.

Luis Toledo's lawyers will determine if they're ready to move the case to trial or if they still need more time to go over evidence.

Prosecutors say Toledo killed Yessenia Suarez and her kids in October 2013, but their bodies were never found.

Suarez and her two children vanished four months ago after Toledo and Suarez had an argument at her work.

Toledo has pleaded not guilty.

Toledo also faces charges of tampering with evidence after deputies reported finding traces of what appeared to be blood in Toledo's home and noticed it had been thoroughly cleaned.
