Driver involved in fight with passenger's husband later struck on SR 44, police say

NEW SMYRNA BEACH, Fla. – A driver was ambushed inside a vehicle Thursday morning by his passenger's husband and was later struck and killed by a car in New Smyrna Beach, according to police.

New Smyrna Beach police said Darrell Fitzwater, 38, and his girlfriend, Donna Lynam, were driving westbound on State Road 44 at 6 a.m. when Lynam's husband, Donald, came out of hiding from the back of the van and attacked Fitzwater.

"I haven't really seen him around lately. I haven't seen the van that he normally has," said Pat Murray, who lives near the Lynams' home.

After not seeing Donald Lynam for some time, Murray knew something was wrong and his suspicions were confirmed Thursday morning.

Fitzwater stopped on State Road 44 and continued fighting with Donald Lynam. Lynam then pushed his wife back into the van and began driving eastbound, leaving Fitzwater on S.R. 44, according to police.

Lynam took his wife's cellphone and threw it out of the vehicle, then called 911 on his phone to report the disturbance, said police.

After being left on S.R. 44, Fitzwater was struck and killed by a westbound driver, police said. At Donna Lynam's home, no one wanted to make a comment about what unfolded. At Fitzwater's Edgewater home, family members said they are still adjusting to what has happened.

Police arrested Donald Lynam at the business he owns, New Smyrna Glass and Design Center and charged him with domestic battery, false imprisonment and depriving a person of communication.
