STARKE, Fla. - A man who raped and killed a 9-year-old boy from Miami-Dade County 18 years ago is scheduled to die by lethal injection.
Juan Carlos Chavez was scheduled for execution at 6 p.m. Wednesday at Florida State Prison in Starke. It was delayed just after 6 p.m. because of a last-minute appeal, WPLG reports.
The Florida State Prison Communications Office confirmed to WPLG that the U.S. Supreme Court is reviewing Chavez's appeal. Until the court's ruling is handed down, the execution is on hold
The Florida Supreme Court denied earlier Wednesday a stay of execution for Chavez, who was seeking time to challenge Florida's method of lethal injection. He still has an appeal pending.
Chavez abducted Jimmy Ryce at gunpoint after the boy got off a school bus on Sept. 11, 1995, in rural southwestern Miami-Dade County. Trial testimony showed Chavez raped the boy, shot him when he tried to escape, then dismembered his body.
Ryce's parents tried to alleviate the pain of the tragedy by pushing for laws regarding confinement of sexual predators and working to improve police procedures in missing child cases.
