Judge refuses to release Luis Toledo from jail

DeLAND, Fla. – A judge on Monday refused to release a Volusia County man accused of killing his wife and her two children from jail.

On Friday, attorneys for Luis Toledo filed motions seeking to have him released from jail or transferred to another facility, and the judge held a hearing on Monday.

Toledo has been jailed since October after deputies say he killed his 28-year-old wife, Yessenia Suarez, and her two children -- a 9-year-old girl and an 8-year-old boy.  Their bodies have not been located.

At the hearing, the warden gave an in-depth look at Toledo's behavior in the Volusia County Jail, saying Toledo stockpiles medicines, as if he will take it all at once. The warden also said Toledo doesn't eat at times and meets with mental health physicians but often doesn't talk.

Toledo has been held in isolation in Volusia County since his arrest and also has maximum security. His attorney says he and his client have little privacy and wants to have Toledo moved to the Seminole County jail.  The judge will rule on the matter at a later date.

Deputies have said that Toledo admitted to killing his wife.  Toledo, however, denied killing Suarez's two children, deputies said.

Toledo faces murder charges in all three deaths.
