Judge rules Luis Toledo statements will be allowed in murder trial

Man accused of killing estranged wife, kids

A judge ruled on Wednesday that most statements from a man, who prosecutors say killed his wife and two children, will be allowed into evidence in his murder trial.

Luis Toledo told investigators that he killed 28-year-old Yessenia Suarez, but has denied killing her two children, ages 8 and 9, inside of a Deltona home in 2013. Their bodies have never been found, but prosecutors say bloodstains were found inside the home.

The judge ruled Toledo's statements he made to police after his arrest in Lake Mary and during the interview at the Volusia County jail will be allowed at his trial.

But the judge did not allow a small part of his second interview with police when he was potential suspect. The judge thought Toledo should have had his Miranda Rights read before police confronted him.
