KISSIMMEE, Fla. – The toddler who police say was thrown from a second-floor motel balcony by his father has been released from the hospital, according to Department of Children and Families.

41-year-old Juan Pablo Maradiaga faces attempted murder charges after he threw a 2-year-old boy from a balcony at the Budget Inn on East Vine Street in Kissimmee on Tuesday.

The toddler was in critical condition at Arnold Palmer Hospital as he recovered from serious injuries, including numerous fractures and contusions. DCF says they have released the boy to his mother, who they say has been cooperating with officials to ensure the boy's safety.

Police said Maradiaga was babysitting the boy when he became frustrated and called to tell the mother she needed to come and get the child. Police said 30 minutes later, Maradiaga tossed the child over the balcony.

DCF says they will move forward with "appropriate legal action" against Maradiaga.

Maradiaga has been discharged from the hospital and is being booked into the Osceola County Jail. 

He will be held on a no bond status.
