Man shot in Daytona Beach found lying on sand, officers say

Suspect in custody, gun recovered after shooting, deputies say

DAYTONA BEACH, Fla. – A man accused of shooting another man on the beach near a restaurant in Daytona Beach early Saturday has been arrested, Volusia County deputies said.

Deputies said Volusia County Beach Safety officers heard gunfire nearby around 1:30 a.m. and were flagged down for help.

Officers found the victim, James Flournoy, 32, lying on the sand near South Ocean Avenue, deputies said. 

The Sheriff's Office said Beach Safety and Daytona Beach police officers gathered information from witnesses and were able to locate the accused shooter, Devin Ross, 26, at the Roomba Inn and Suites. The handgun used in the shooting was found and recovered by police, deputies said.

The Sheriff's Office later took over the investigation. Deputies interviewed Ross, who told them the incident began after Flournoy, who Ross said appeared to be drunk, started yelling obscenities at Ross' girlfriend and her child, the Sheriff's Office said. Ross said Flournoy tried to hurt him after he told Flournoy the obscenities were unnecessary, deputies said, which is when the shooting began.

Flournoy was taken to Halifax Health Medical Center to be treated for his injuries, deputies said.

Beach Safety officers charger Ross with carrying a concealed firearm without a permit, deputies said. The Sheriff's Office is still investigating the shooting.
