Man accepts plea deal in Publix upskirt case

ORLANDO, Fla. – The man arrested in connection with separate incidents at a Publix in Orlando accepted a plea deal Friday.

Scott Irwin, 27, was seen on surveillance video putting his cellphone in a basket and recording videos under the skirts of girls between the ages of 5 and 13.

Irwin accepted a deal in which he pleaded guilty to three counts of video voyeurism. He received two years of community control probation for count one and five years of supervised sex offender probation for the others.

Each count carries a maximum penalty of 15yrs in prison, so Irwin could have received 45 years if a jury had found him guilty. 

In a recorded interview with Orlando police, a shopper told investigators that he watched Irwin use his cellphone to shoot video around the legs of at least two girls.

"I questioned myself," he told police. '''Did I really see what I thought I saw?' I went and got my kids and came back to the area where he was at and witnessed him do it to another child."

The witness described what happened.
"He took the Publix basket, the handheld basket, and he would put a box of saltines or some sort of box in there to elevate his phone. He would turn his phone upside down with the camera pointing up, and then he'll walk over, and then hover around these victims that he was videotaping," he said.

The witness complained to management, who called Orlando police.
Irwin was arrested days later.

In his police interview, Irwin did not admit anything, nor did he deny anything.

Irwin was charged with two counts of video voyeurism.
