ORLANDO, Fla. – An 87-year-old Marion County man who contracted fungal meningitis in the nationwide outbreak caused by tainted injections will file a lawsuit against the pharmacy that distributed the steroid.
Attorney Christopher Chestnut, who's representing Godwin Mitchell and his wife Catherine Mitchell, will file the lawsuit Thursday in Orange County. The Mitchells are suing the New England Compounding Center for negligence and liability, seeking damages in excess of $15,000.
According to Chestnut's office, Godwin Mitchell received a tainted steroid injection at the Marion Pain Management Center that was distributed by the New England Compounding Center.
Godwin Mitchell is partially paralyzed and currently in critical condition at a Marion County-area hospital, Chestnut's office said.
The fungal meningitis outbreak has resulted in 19 deaths and more than 240 cases across 15 states, including three deaths in Marion County, Fla.
Chestnut's office initially identified Godwin Mitchell as a 78-year-old man.
