DELTONA, Fla. – A judge has set a new court date for the man accused of killing his wife and her two children.

Luis Toledo has been jailed since October after deputies say he killed his 28-year-old wife, Yessenia Suarez, and her two children -- a 9-year-old girl and an 8-year-old boy. Their bodies have not been located.

Toledo appeared in court on charges related to the death of Suarez's two children on Tuesday. He says that someone else killed the children.

The judge said Toledo will appear in court again on March 18. The defense also asked for a continuance, saying it is not getting evidence from the state in a timely manner.

Meanwhile, evidence released on Monday showed the hours before Suarez and her children disappeared.

"We've been having problems," Suarez told Lake Mary police. "I told him last weekend I don't want to be with him. Then he's been you know harassing me."

The 25 pages of evidence also confirmed that Suarez was having an affair with a co-worker.

In investigative reports from detectives, Suarez' co-worker Kevin Dredden admits the two were having an affair. He says they had gone together on a business trip out of state on which "he knew they were going to end up sleeping together."

According to the report, Dredden had warned Suarez "nothing positive was going to come of her going home to Toledo," to which Suarez responded being there would help smooth things out.

In the report, Suarez told her co-worker Toledo had been violent toward her before and that he had choked her and came at her with a knife at one point.
