New Smyrna 18-year-old charged with raping 13-year-old girl

NEW SMYRNA, Fla. – An 18-year-old boy was arrested Sunday after witnesses said he raped a 13-year-old girl in an abandoned New Smyrna Beach house, according to the Volusia County Sheriff’s Office.

Two boys, 13 and 14 years old, told police they were walking by the house on Elizabeth Street when they heard a girl “screaming” inside, according to the report. The boys went into the house to help the girl and saw two of their friends having sex, deputies said.

The boys identified Kelly Shaw, 18, and a 13-year-old girl as the two people they saw to deputies. Deputies found Shaw and the victim inside the house a few minutes later.

Deputies found underwear at the scene and said Shaw had several hickeys on his neck.

Shaw told deputies he has sexual intercourse with the victim three times, including the Jan. 13 incident.

Shaw said he recently returned to Volusia County from an 11-month commitment program in Tampa for a battery charge, according to the Sheriff’s Office.

The 13-year-old girl’s mother said she would pursue sexual battery charges against Shaw on behalf of her daughter.

Shaw was booked into the Volusia County Jail on three charges of sexual battery without physical force on a victim 12 years or older.
