Incident with Orlando police captured on video

ORLANDO, Fla. – A man convicted after a controversial confrontation with Orlando police was sentenced Monday to two days in jail.

Noel Carter, who was found guilty last month of battering officers and resisting arrest in the June 2015 incident, won't have to spend any time in jail, however, because he was credited with time served.

Carter was also sentenced to four years of probation and 200 hours of community service, and the judge withheld adjudication, meaning he won't be considered a convicted felon if he completes his sentence.

Carter's sentencing came weeks after his lawyers demanded a new trial. They maintained Carter was the victim in the confrontation, a portion of which was captured on video.

The video shows two Orlando police officers kicking, shocking with a Taser and pepper-spraying Carter. The officers were cleared of any wrongdoing.

During his trial, Carter took the stand in his own defense, saying that a misunderstanding led to the incident.

Carter said in court that he and his girlfriend went to a club and had several drinks before getting into an argument about one of her male friends. Carter admitted that he grabbed her elbow and she left the club crying.

Carter said he was trying to talk to her when police intervened and told him to leave, but things quickly escalated.

Carter said he ran away from the officers, who then began kicking him.

He said he thought he was going to die, so he tried to get away, but realized that was not the right decision.

The officers said kicking Carter was their last option.

"Why did you kick him as he sat on the ground?" the state asked. "Because I felt like he was still ready to fight. He had been sprayed. He had been hit with an expandable baton. He had been tased twice, and none of that had an effect on him," Orlando police Officer Charles Mays said.
