Police: 'Finger-Gun' Used In Theft Attempt

19-Year-Old Charged With Attempted Robbery

A 19-year-old tried to hold up a Volusia County convenience store on Sunday night using his finger as a pretend gun, according to sheriff's deputies.

Justin MacGilfrey, of South Daytona, was arrested on attempted robbery charges after the incident at the Circle K, located at 1800 S. Nova Road near Daytona Beach.

According to Volusia County sheriff's deputies, MacGilfrey entered the store at about 8 p.m. and told the clerk, "Give me all the money in the register." The clerk, who had been looking down at the time, thought someone was playing a prank on him but looked up and noticed MacGilfrey pointing a finger at him, apparently pretending that it was a gun, deputies said.

The 22-year-old clerk walked out from behind the counter, and MacGilfrey ran out of the store, sheriff's deputies said.

MacGilfrey was later found when Daytona Beach police responded to a disturbance call.

Volusia County sheriff's deputies said MacGilfrey admitted to the Circle K attempted robbery but claimed that someone else forced him to commit the crime and had threatened him with a weapon if he did not comply. The story could not be confirmed, deputies said.

MacGilfrey was arrested and transported to the Volusia County Branch Jail in Daytona Beach.
