Timothy Davis Sr. was charged with second-degree murder with a firearm after he told authorities that he shot his 22-year-old son during an October 2011 argument about a custody dispute over his grandson.

Davis testified on Friday saying it was self defense when he shot his son and that he had to protect himself and his family.

"I loved my son more than anything in the world," Davis said, calling his son "out of control."

Davis' wife, Tarsha Davis, took the stand and said she didn't know Davis went to go get a gun, but knew that he kept the gun in the car.

Davis' attorney tried to get to get evidence in the case thrown out, but a judge denied the motion back in August.
