DeLAND, Fla. – The city of DeLand has reached a settlement on Wednesday with the estate of Marlon Brown, the man who was killed after being run over by a DeLand police officer.
City Manager Michael Pleus tells Local 6 the family of Brown will receive a $550,000 settlement, representing a "full and final settlement of any and all claims against the city."
Since the crash, Officer James Harris was fired and on July 11, the Florida Highway Patrol handed over dash camera video, radio transmissions, all evidence and the findings of their investigation to the State Attorney's Office.
Brown's family had previously called for charges to be filed against Harris in Brown's death. It's not clear if charges have been filed yet.
Investigators say on May 8 law enforcement officers tried to pull Brown over for not wearing a seat belt but Brown wouldn't stop and a chase ensued with DeLand police joining. Brown jumped out of his car and ran away, troopers said.
As Harris arrived on scene, he drove more than 100 feet off the road through a backyard fence and ran over and killed Brown, troopers said. Four other passengers in Brown's vehicle were not injured.
A meeting will be held on Wednesday at 6:30 p.m. for the commission to approve the settlement.
Brown's ex-wife, Krystal Brown spoke to Local 6 before the meeting, and said settling with the city is what's best for her and her children.
"Based on everything, the information that we've been giving, again the rules and the laws and the small print, right now it's just time for us to move forward with ending the civil matters with the city of DeLand and we're pressing forward with the criminal," she said. "It's hard to feel excited or happy about it, because again, it doesn't amount or bring him back in any way, I was actually hopeful thinking that it would be different, that you would have a different feeling but you don't."
