Ex-wife of man killed by DeLand officer says she has right to see video

DeLAND, Fla. – The family of Marlon Brown says they took a giant step forward on Wednesday in their fight for the dash cam video they hope will give them answers and closure.

After DeLand police refused to give Krystal Brown video from the night her ex-husband Marlon Brown was killed by an officer, because they said the state attorney wouldn't allow them to, Local 6 told DeLand City Attorney Darren Elkind.

He tells Local 6 the city will release all their video to Brown's family, because Krystal Brown has a signed and notarized letter from Marlon Brown's father, William Brown, giving her permission to see it.

State law says video that shows the killing of a person can be viewed and copied by certain surviving family members. Brown's father is that person.

"I have the letter of permission from the father, to obtain the video as well as guardianship of Marlon's children, I'm the representative of his estate, I've also consulted that with my attorneys- so there's no reason why I, Krystal Brown, should not be given the video today," said Krystal Brown.

Calls made to state attorney R.J. Larizza were not returned on Wednesday.

Elkind tells Local 6 he will be releasing some portions of the video that do not show Marlon's death to the general public on Thursday.?
