Man faces driving under the influence charges

DELTONA, Fla. – Volusia County deputies arrested a man on driving under the influence charges after they say he was found passed out behind the wheel holding a half-eaten burrito from Taco Bell.

Daniel Hernandez, 36, was spotted by deputies early Monday morning passed out in his 2002 Acura with the vehicle running in drive at the intersection of Courtland Boulevard at Doyle Road for at least 15 minutes, according to the report.

Deputies said they attempted to wake up Hernandez for 10 minutes by banging on the doors and windows, but were unsuccessful. They then had to break the rear passenger window and unlock the front door to stop the vehicle to prevent Hernandez from lifting his foot from the brake, according to the report.

When Hernandez woke up, he told deputies he had his last drink at around 11 p.m. Hernandez was arrested after not completing the field sobriety exercises and booked into the Volusia County jail.

His blood alcohol level was a .173, according to the report.
