Man shot by Orange County deputy may file lawsuit

Cedric Bartee shot during stolen car investigation

ORLANDO, Fla. – Attorneys representing a man shot by an Orange County sheriff's deputy held a news conference Friday afternoon.

Cedric Bartee, 28, was shot by Orange County Deputy Robert McCarthy earlier this month.  Bartee was struck in the torso and spent days in a hospital before being released.

Attorneys for Bartee said they are conducting an investigation into the shooting and anticipate filing a claim for civil damages.

Attorneys said they believed the deputy used an "unjustified use of excessive force."

Investigators said Bartee was behind the wheel of a stolen car and would not keep his hands up after being confronted in the parking lot of an apartment complex.

Two witnesses, however, say Bartee had hands up at the time of the shooting.

So far, Bartee has not been formally charged.

Bartee did not appear at the news conference.
