BREVARD COUNTY, Fla. – The man accused of shaking his girlfriend's baby to death appeared in court on Monday and pleaded not guilty to first-degree murder
Joseph Lamay, 24, was found in California in October and arrested on unrelated charges.
Police said in September Lamay called 911 to report that an infant was unconscious and not breathing.
Authorities were called around 1 a.m. Sept. 26 to an apartment in Palm Bay after Lamay contacted 911. When paramedics arrived, they rushed Lorenzo to the hospital where he later died, according to officials.
Investigators said Lamay, Lorenzo's mother's boyfriend, was babysitting the 4-month-old and was the only person in contact with him after the baby's father put him to sleep around 10:30 p.m.
The Medical Examiner's review of the circumstances surrounding 4-month-old Lorenzo Hernandez' death is consistent with shaken baby syndrome.
