Motion to dismiss charges denied for OPD officer

ORLANDO, Fla. – A motion to dismiss charges against an Orlando police officer who was charged in a shooting while on duty has been denied, according to the State Attorney's Office.

David Johnston is being charged with shooting into an occupied vehicle and discharging a firearm in public for shooting at a man police said almost ran over an officer while fleeing police in a parking garage in February 2014.

The motion for dismissal of the charges, heard Thursday, was denied. State attorneys said Johnston will be back in court for the case some time in May.
