DeLAND, Fla. – A man charged with murder in the death of his wife and her two children was forcibly taken to court Friday morning, according to the judge in the case.

Luis Toledo is accused of killing his wife, Yessenia Suarez, and her two children in 2013. Their bodies have not been found.

At Friday's hearing, Toledo's lawyers withdrew a motion for a speedy trial, without explanation.

The judge said Toledo had to be forcibly taken to court Friday, although Toledo told the judge during the hearing that he cooperated with authorities and arrived voluntarily.

Toledo's trial was supposed to start last month, but it was put on hold after the state's death penalty law was ruled unconstitutional. 

Officials have said that Toledo admitted to killing his wife but denied killing her children.
