Man injured by falling tree awarded $1 million

City inspection showed tree had limb decay, was scheduled for removal

ORLANDO, Fla. – The courts have awarded a local man a $1.16 million settlement after a tree crashed into his car, injuring him.

Trino Valdez was parked at Dickson Azalea Park in Orlando when a tree snapped and crushed his car in 2012 with him inside. Valdez underwent three surgeries, and had screws and rods placed into his neck and back.

He sued the city after learning a 2007 inspection showed the tree had limb decay, and was scheduled for a “priority 2 removal.” However, the tree was never removed.

The city maintains it did not not know the extent of the tree decay because it was still green and leafy on the outside.
