Palm Bay man charged with sexually assaulting 17-year-old while she was sleeping

Suspect claimed he thought teen was 22, police say

BREVARD COUNTY, Fla. – A 24-year-old Palm Bay man remains jailed on charges he sexually assaulted a sleeping 17-year-old over the weekend following a visit to a nightclub together.

Joshua Cinton Rivera was charged with sexual battery after the girl alerted a friend about the Saturday night incident, reports show. 

Palm Bay investigators said the teen was visiting from out of town and went along with another woman to a downtown Melbourne club, according to News 6 partner Florida Today. The friend also brought along her friend, Rivera, reports show.

Police said the teen and the others got back home about 4 a.m. A short time later, the teen woke up to find Rivera hovering over her, fondling her and performing sexual acts.

The teen, who resisted, then moved to another room and later told her friend.

Rivera told officers he initially thought the teen was 22 years old, but said he learned she was a teen. Rivera was then booked into the Brevard County Jail Complex. He is being held on a $35,000 bond. No court date has been set.
