‘I’ll just kill you:’ Daytona Beach man accused of sexually assaulting, hospitalizing woman

Marshall Lyons, 27, faces charge of aggravated battery

DAYTONA BEACH, Fla. – Police in Daytona Beach announced they have arrested a suspect on an aggravated battery charge after an attack that sent a woman to the hospital.

The woman told investigators she was sexually assaulted, beaten and held hostage overnight, according to a report obtained by News 6.

Marshall Lyons, 27, appeared in front of a judge at the jail in Volusia County Wednesday.

Daytona Beach police arrested him near South Martin Luther King Jr. Boulevard and Live Oak Avenue the day before an active warrant for the charge of Failure to Appear in reference to a previous misdemeanor charge.

Lyons did not say anything about the accusations against him at the hearing. However, an incident report from police gives more insight into the allegations.

It describes the victim denying advances from Lyons, to which he reportedly responded, “If I can’t have sex, I’ll just kill you.”

The victim told officers he grabbed a rolling pin and hit her in the head multiple times. She grabbed a piece of glass and cut him, according to the report.

The report goes on to say that the woman was sexually assaulted and tied up with bed sheets. According to the report, she told officers she was able to free herself using a knife and went to get help.

However, the report doesn’t make clear how the suspect and victim knew each other. She told first responders that she stabbed the man she knew as “Marshall” to get away.

The person who called for help told detectives the victim had recently made another report. News 6 also obtained a copy of that document that also describes a sexual assault in March.

The report says the victim asked her attacker, “Do you think I won’t remember you?” and he responded, “Is that a threat? Because I don’t care. You’re victim No. 7.”

News 6 asked Daytona Beach Police whether they believe Lyons is the suspect in both battery cases. We are waiting to see whether they can confirm that.

Lyons faces charges of aggravated battery and failure to appear. He is held on $50,500 bond.

Police said it is possible that more charges are forthcoming based on how their investigation plays out.
