OPD officer Sean Gihuly, 30, was pulled over by Oviedo police early Sunday morning while off-duty at State Road 434 and Mitchell Hammock Road after a caller reported a possible intoxicated driver.

According to the report, Gihuly was sitting in the eastbound lane at a traffic light not moving, causing a safety hazard. Police said they saw an open bottle of Peach Ciroc liquor in the front passenger seat and asked Gihuly if he had been drinking, to which he said he hadn't.

Gihuly also refused to do field sobriety tests and told the officer repeatedly, "Don't expletive me over." He was taken to Seminole County jail, where he became combative and kicked out his passenger-side rear window, according to the report.

He was charged with criminal mischief over $200 for the damage on the police car, according to the report, and was also given two traffic citations.

Gihuly was hired in 2011 and assigned to the patrol division. He has been relieved of duty with pay as the internal investigation is conducted.
