Cherish lived with her mom, two younger sisters and her mom's boyfriend in on Jacksonville's Westside.

JACKSONVILLE, Fla. - The man accused of killing an 8-year-old Jacksonville girl has been indicted on charges of first-degree murder, kidnapping and capital sexual battery.

The State Attorney's Office says 56-year-old Donald Smith was indicted on Tuesday. The indictment also says that Cherish Perrywinkle was strangled.

Authorities had earlier released few details on how Cherish died or whether she was sexually abused. Her body was found near a church on June 22.

Smith had a lengthy rap sheet of convictions for sex crimes against children and had gotten out of prison less than a month before Perrywinkle was killed. He's being held in jail without bail, awaiting his next court hearing.
