Condition of critically wounded Pulse survivor improves

Unidentified patient upgraded to guarded condition

ORLANDO, Fla. – The only survivor of the Pulse nightclub massacre who was still in critical condition has seen their condition improve, Orlando hospital officials said.

Orlando Regional Medical Center officials said the unidentified patient's condition was upgraded Tuesday to guarded. Officials did not provide further details.

Two days after the June 12 shooting, six victims had remained in critical condition. At the time, Dr. Michael Cheatham said he feared the death toll could go higher. But all six patients have survived.

The attack killed 49 people and injured more than 50 others, making it the deadliest mass shooting in modern U.S. history.

The gunman, Omar Mateen, was killed by police after a three-hour standoff.

Meanwhile, attorneys for almost two dozen media groups are arguing in federal court that a lawsuit demanding the release of 911 calls involving the Pulse nightclub shooting should be moved back to state court.

Attorneys for The Associated Press, CNN, The New York Times and other media groups are arguing Thursday that the case doesn't belong in federal court.

The case pits the city of Orlando against media companies seeking the release of recordings of dozens of 911 calls as well as communications between Mateen and the Orlando Police Department. 

The city claims the recordings are exempt under public records law.
