Man arrested more than 5 months after deadly Melbourne arson

MELBOURNE, Fla. – A man is locked up after Melbourne police said he started a fire on the back porch of a home that killed another man.

Theodore Noe, 43, is being held without bond in Volusia County after Port Orange police arrested him on Monday. Investigators said Noe will be extradited back to Brevard County.

Police were called to a home at 1827 Guava Ave. on Nov. 15. Investigators said someone set the back porch of the home on fire.

Officers found the victim, identified as David Here, according to a news release. He had been badly burned and taken to the hospital where he ultimately died.

Investigators said Herles and Noe were both homeless and had been given permission to shelter on the back porch of the home prior to the fire.

A warrant for Noe’s arrest was issued on April 26. Port Orange police learned Noe was working and temporarily living in the city, according to the release. Noe was contacted and arrested without incident.

He faces charges of first-degree murder and arson of a dwelling.
