DeLAND, Fla. – The state attorney's office announced the grand jury won't indict the former DeLand police officer, who ran over and killed a man, on criminal charges.
Marlon Brown's family waited beside the podium as the state attorney made the jury's decision on Tuesday that no criminal charges will be filed against former DeLand police Officer James Harris.
"Justice is what has to happen here, and the grand jury has spoken, and their decision is final," said State Attorney R.J. Larizza.
Marlon Brown's ex-wife, Krystal, says she will continue to fight for charges against Harris, and she wants to see the dash cam video from Harris' patrol car.
Larizza said he could not release the video to the public, because it shows the death of a human being.
Krystle Brown feels the video may be the reason why DeLand Police Chief William Ridgway fired Harris on May 31- before Florida Highway Patrol troopers finished their investigation.
Ridgway says he fired Harris because he violated department policy.
"This is a tragedy regardless of criminal charges, we are going to evaluate our policies, tactics, to see if we can make any adjustments," he said.
The state attorney's office had been reviewing the Florida Highway Patrol's investigation into Brown's death since July 2013, but ultimately decided to have a grand jury to review the evidence.
Brown was killed in May after Harris ran him over with his patrol car. Brown was running from police for an apparent seat belt violation when he was killed.
Brown's family accepted a $550,000 settlement with the city but they still wanted Harris to face charges.
Harris was fired from DeLand Police Department in July.
