Man charged with attempted murder, aggravated stalking, Volusia Co. deputies say

DAYTONA BEACH, Fla. – A Daytona Beach man has been charged with attempted murder and aggravated stalking, according to the Volusia County Sheriff's Office.

Emory Tellis, 46, is in the Volusia County Branch Jail on charges of attempted murder, two counts of aggravated stalking, aggravated assault, criminal mischief and possession of a firearm by a convicted felon, deputies said.

On Nov. 5, Tellis hid outside the home of a 48-year-old man on Forestwood Street and opened fire on him and his wife. Deputies said the victims initially didn’t provide much cooperation in the incident, but investigators learned that the man and his wife were estranged due to an affair she had with Tellis.

On Tuesday, on Forestwood Street, Tellis reported to sheriff's investigators that the man had fired three shots at him, according to the Volusia County Sheriff's Office. However, investigators determined Tellis had fired on the man.

Also at the scene of Tuesday's shooting incident, investigators said they were able to view surveillance of the prior shooting in November, including footage of Tellis holding a pistol. Deputies said the footage contradicted Tellis' earlier claim that he never had a gun that day.

On Wednesday, Tellis slashed the man's wife's tires, according to the Sheriff's Office. He also called her, admitting to the slashing and threatening to burn down her house and business, and kill her husband, deputies said.

Deputies said they ensured the man and woman's safety and monitored Tellis, who was seen at their home later that night. They stopped him and upon searching him, deputies found latex gloves in his back pocket.

Tellis, who is a six-time convicted Florida felon, is on active federal felony probation stemming from a 2002 conviction for his part in a large-scale Daytona Beach-area cocaine distribution ring, according to the Volusia County Sheriff's Office.

Tellis was arrested Wednesday night on the aggravated stalking and criminal mischief charges and booked into the jail without bond.

After further investigation and interviews, additional charges were added Thursday. Deputies said more charges are expected in the coming days.
