Affidavit: Murder suspect was former employee

Police: James Seagraves, 29, shot and killed restaurant manager

DeLAND, Fla. – An affidavit detailing the investigation into the man who shot and killed the manager of a popular restaurant says that the suspect was a former employee on a crime spree.

Police said Mainstreet Grill manager Tom Walsh, 44, was found shot to death at the restaurant on New York Avenue in April. Investigators believe he was alone in the restaurant at the time of the shooting and another employee returned to the restaurant and discovered Walsh.

James Seagraves, 29 and Kayla Nemoto, 20, were found dead with gunshot wounds in their heads in a Hillsborough County trailer after a standoff with authorities trying to serve an arrest warrant on the murder charges on Thursday. Deputies said they believe they had a suicide pact, but have not released any other details.

According to the report, police believe Seagraves was on a robbery spree, and Nemoto, who was four months pregnant, was an accomplice in some of them.

Police said Seagraves is a former employee at Mainstreet Grill and was a suspect in several robberies up until May, including Mainstreet Grill.

Police said in an interview with Phil Martins, owner of the restaurant, Seagraves was a dishwasher at Mainstreet Grill, meaning he was one of the last people in the restaurant at night and knew the closing procedures. Seagraves, also known as "City Boy," was fired from his position after he tripped an electrical breaker causing the restaurant to lose power during operational hours.

Witness interviews said that Seagraves and Nemoto were spotted around the restaurant the night Walsh was shot and killed. According to the report, Nemoto went into the restaurant, used the bathroom twice and asked what restaurant manager was on-duty.

Surveillance video also captured Nemoto and Seagraves around the restaurant and Martins was able to positively identify them, according to police.

According to the report, Seagraves took about $4,000 from the Mainstreet Grill the night of Walsh's murder. Two days after the killing, investigators said Seagraves purchased a Honda motorcycle for $3,339.68.

Seagraves was recently released from prison March 2 and lived with Nemoto and her mother up until Monday, when her mother kicked them out.

911 calls were also released from the night Walsh was found by another employee.

"I had just come in from taking out my trash and my manager is laying down, he's .. I  don't know he's in a pool of blood please hurry, hurry," the caller said. "I didn't touch him. I didn't go near him ma'am. I seen the blood and I just immediately walked away and dialed 9-1-1."

Walsh was also spotted earlier in the night talking to a man, later identified as Seagraves. The last time Walsh had talked to Seagraves before that night was during the holidays in 2011 where Seagraves approached him about employment opportunities.
