Orange County clerk discusses same-sex marriage license requirements

Judge clears way for same-sex marriage as of Jan. 6

A federal judge has cleared the way for same-sex marriages to be performed in the state of Florida, beginning on Jan. 6.

ORANGE COUNTY, Fla. – The Orange County Clerk of Courts held a news conference on Friday to discuss marriage license requirements and options for same-sex couples.

The clerk's office will start issuing same-sex marriage licenses on Tuesday, days after a federal judge clarified his initial ruling, which overturned the ban on same-sex marriage in the state, saying clerks of court in all Florida counties must issue licenses.

Clerk Tiffany Moore Russell highlighted requirements for obtaining a marriage license at the news conference. She said although language on the marriage license will likely not be updated by Tuesday and will still say "bride/groom," the license will be legal.

There is a three-day waiting period for a marriage license unless the online premarital course is completed online before the application is submitted, Russell said.

Russell also said that none of her peers have said they will not issue licenses on Tuesday.

The Florida Court Clerks and Comptrollers released a statement Friday afternoon regarding the federal judge's clarification.

"Given this development, we are strongly encouraging all Clerks to follow this clarification order and to begin issuing marriage licenses to same-gender couples on January 6, 2015," Executive Director Kenneth A. Kent said in a release.
