No charges filed in Disney Springs fight

Man arrested on battery charges after fight with staff at Bongos Cuban Cafe

After panic inside Disney Springs on Christmas Day, the State Attorney's Office has decided there isn't enough evidence against Luis Ojeda Reyes, 70, to press charges.

Ojeda Reyes was arrested for battery after he allegedly became physical with staff at Bongos Cuban Café.

State Investigators said on Wednesday that conflicting witness statements played a role in deciding to stop pursuing charges.

A near riot occurred inside Disney Springs after someone shouted they heard gunshots. Several people were trampled over as people ran for the exits.

Ojeda Reyes told News 6 he's a Vietnam Veteran, and was simply trying to enjoy a holiday meal, when restaurant staff became aggressive towards him after complaining about slow service.

"I kept telling him leave me alone. Get out of my face," said Ojeda Reyes. "I got mad. I got up. I hit the table with my fist. I was wearing my Vietnam hat because I'm a Vietnam veteran and threw it on top of the table."
He said that the manager got in his face, and even other staff pulled the manager away.

When he went to leave, he claims staff was blocking the exits.

Ojeda Reyes said that a staff member hit him in the back, and another grabbed him from the front.

"In a very hard way that caused pain in my chest with pulling, pulling my muscles and my rib cage hard," said Ojeda Reyes. "At that point, everybody jumped on me. Everybody jumped on me. I don't know if it was customers. I don't know if it was bodyguards, I don't know. I don't know who it was."
He was eventually able to leave the restaurant, but not long after sheriff's deputies showed up.

After bystanders reported hearing gunfire, officers had the understanding he had a firearm.

"I don't have a gun. I don't believe in guns. He said well there were gunshots fired out there. I don't know. I don't have no guns. I don't believe in guns," said Ojeda Reyes.

He said that he spend several hours at a sheriff's location inside Disney.
   
"Questioning and talking and really to my interpretation, we were socializing," said Ojeda Reyes. "They took my handcuffs off and they told me to sit down and relax. And I still believe to this day that those officers knew or felt that I had nothing, I had done nothing wrong."

After being released from jail, Ojeda Reyes said that he went to the hospital.

"I got X-rays, neck, knee, hip because in the process of falling on the floor, I lacerated my hip and my knees," said Ojeda Reyes.

He also said that he is still deciding whether to file civil charges against the restaurant and the mangers.

When News 6 reached out to Bongos Cuban Café, the restaurant said it had no comment.
