SANFORD, Fla. – Circuit Judge Donna McIntosh reserved ruling Friday in the James Hataway case, the court said.
Hataway, 35, who is considered the prime suspect in one of Central Florida's most high-profile missing persons cases, was in court Friday seeking a new trial in another case.
Hataway is serving a life sentence in an attack on a woman in Seminole County in 2008. He's also a suspect in the disappearance of Tracy Ocasio, who was last seen leaving a Metro West bar with Hataway in 2009.
Hataway, who was found guilty of attempted murder, false imprisonment, burglary with an assault and robbery, claims the lawyers in the Seminole County attack case made several errors.
Judge McIntosh was supposed to rule on whether a state witness, a prison inmate, should have been allowed to testify.
The witness told jurors that Hataway said he tried to strangle Rachel Clarke, 21.
The judge will also hear arguments about the victim's blood alcohol level, whether he waived his right to a speedy trial and if a robbery charge should have been considered.
