VOLUSIA COUNTY, Fla. – A Volusia County man was arrested after he and his neighbor got into a dispute over a dog that she said was loose on her property. The woman was reportedly injured from shattered glass prompted by a gunshot early Thursday morning.
The victim told police she went to 71-year-old Robert Mosher's home at 1 a.m. after a small dog that was on the loose attacked her horses on her property.
Deputies said Mosher told them he was sleeping when he heard someone pounding and kicking his front door.
He told deputies he grabbed his 9mm handgun and went to check on the noise. He said he saw a shadow through the front window and fired a shot.
He opened the front door of his home and fired an additional shot at the woman he saw fleeing from his home.
The victim, 38-year-old Michelle Simpson, told deputies that she was scared and started running down the driveway when she heard the front door open.
"I honestly think he was trying to shoot in my opinion, to harm," Simpson said. "He didn't even say anything before he shot through the door. Nothing."
She told deputies she saw Mosher naked by his front door.
The victim also told deputies that she thought she was shot, but realized the shattered glass was the cause of the injuries to her arm and abdomen.
Mosher was charged with aggravated battery with a deadly weapon in the incident and was released after posting $20,000 bond.
